Terms of Use

These Terms of Use ("Terms") are an agreement between you and AIVIATION LLC, a Florida limited liability company ("AIVIATION," "we," "us"), and they govern your use of the aiviation.dev website, including the partner flight-school landing pages hosted under aiviation.dev (together, the "Website"). By using the Website, you agree to these Terms. If you do not agree, do not use the Website.

1. About AIVIATION LLC and These Terms

AIVIATION LLC develops iOS applications for pilots: RegBrief, WilcoAI, Checkride.bot, and Clearance AI (each, an "App"). These Terms govern the Website. Each App is licensed to you under its own terms, linked in Section 3.

Where these Terms and an App's own terms differ about that App, the App's terms control for that App.

2. Acceptance and Eligibility

By accessing or using the Website, you agree to these Terms. If you do not agree, do not use the Website.

You must be at least 16 years old to use the Website or any App. If you are under 18, a parent or legal guardian must read and accept these Terms on your behalf before you use the Website or an App. In that case the parent or legal guardian is the contracting party, is responsible for your use, and is bound by these Terms. All purchases must be made by an adult.

The Website and the Apps are offered in the United States and are intended for use there.

Each App has its own Terms & Conditions governing its use, including the safety and training-aid disclaimers specific to that App. By downloading and using an App, you agree to its terms:

Our Privacy Policy describes what information we collect through the Website, how we use it, and with whom we share it. It is incorporated into these Terms by reference. By using the Website you acknowledge that you have read it. If these Terms and the Privacy Policy conflict about the collection, use, or disclosure of personal information, the Privacy Policy controls.

5. Use of This Website

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Website for your own personal, non-commercial purposes. You may not: (a) sell, rent, lease, sublicense, distribute, or commercially exploit the Website or its content; (b) modify, create derivative works from, disassemble, reverse-compile, or reverse-engineer any part of the Website; (c) use the Website to build a competing product or service; (d) scrape, harvest, or use automated means to collect content or data from the Website in a way that burdens our systems; or (e) interfere with, disrupt, or attempt to gain unauthorized access to the Website or the systems that serve it.

We may modify, suspend, or discontinue the Website or any part of it at any time, with or without notice, and we have no obligation to provide support or maintenance for the Website.

The aiviation.dev website, its content, app icons, and branding are © 2026 AIVIATION LLC. "AIVIATION," "RegBrief," "WilcoAI," "Checkride.bot," and "Clearance AI" are trademarks of AIVIATION LLC. You may not reproduce or distribute our content without written permission. All rights not expressly granted in Section 5 are reserved. Trademarks, logos, and service marks of third parties that appear on the Website belong to their owners.

If you send us feedback or suggestions about the Website or an App, you grant us a perpetual, irrevocable, worldwide, non-exclusive, fully paid, royalty-free license to use that feedback for any purpose, without compensation or attribution. Please do not send us feedback you consider confidential or proprietary.

7. Third-Party Services, Other Users, and Release

The Website links to websites and services operated by third parties, including the App Store, our partner flight schools' websites, and our social-media pages ("Third-Party Services"). We do not control, endorse, or take responsibility for Third-Party Services. You use them at your own risk, and the third party's own terms and privacy practices apply.

Your interactions with other people you encounter through the Website, including our partner flight schools, are solely between you and them. We are not responsible for any loss or harm arising from those interactions, and we have no obligation to become involved in a dispute between you and a third party.

To the fullest extent permitted by law, you release AIVIATION LLC and its members, officers, employees, and agents from all claims, demands, and damages arising out of or related to Third-Party Services or your interactions with other people you encounter through the Website. If you are a California resident, you waive California Civil Code Section 1542, which provides: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party." This release does not apply to any claim arising from our own acts or omissions, and nothing in it limits any right you have that cannot be waived under applicable law.

8. Website Disclaimer

The Website is provided for informational purposes. Nothing on the Website is flight instruction, regulatory advice, or a substitute for official FAA publications, an authorized flight instructor, or the pilot in command's own judgment and responsibility. AIVIATION LLC is not affiliated with, endorsed by, or sponsored by the Federal Aviation Administration.

THE WEBSITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, AIVIATION LLC AND ITS SUPPLIERS DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED, AND STATUTORY, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, ACCURATE, COMPLETE, OR FREE OF HARMFUL CODE. SOME STATES DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THESE EXCLUSIONS MAY NOT APPLY TO YOU.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW: (A) AIVIATION LLC AND ITS SUPPLIERS WILL NOT BE LIABLE FOR ANY LOST PROFITS, LOST DATA, COSTS OF SUBSTITUTE PRODUCTS, OR ANY INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF, OR INABILITY TO USE, THE WEBSITE; AND (B) OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE WEBSITE IS LIMITED TO THE GREATER OF (i) FIFTY U.S. DOLLARS ($50) AND (ii) THE AMOUNT YOU PAID US IN THE SIX MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. THE EXISTENCE OF MORE THAN ONE CLAIM DOES NOT INCREASE THIS LIMIT.

Some states do not allow the exclusion or limitation of certain damages, so parts of this Section may not apply to you. Nothing in this Section limits liability that cannot be limited under applicable law, including liability for fraud, gross negligence, or willful misconduct.

10. Indemnification

You agree to defend, indemnify, and hold harmless AIVIATION LLC and its members, officers, employees, and agents from any third-party claim, and any reasonable costs and attorneys' fees, arising out of (a) your use of the Website, (b) your breach of these Terms, or (c) your violation of applicable law. We will notify you promptly of any claim we become aware of, and we may assume sole control of the defense and settlement of the claim at your expense, in which case you agree to cooperate with us. You may not settle any claim covered by this Section in a way that imposes an obligation on us without our prior written consent.

11. Term and Termination

These Terms apply for as long as you use the Website. We may suspend or terminate your access to the Website at any time, including if we reasonably believe you have breached these Terms or applicable law. You may stop using the Website at any time.

Sections 4 (Privacy), 6 (Intellectual Property and Feedback), 7 (Third-Party Services, Other Users, and Release), 8 (Website Disclaimer), 9 (Limitation of Liability), 10 (Indemnification), 11 (this Section), 12 (Apps Obtained From the App Store), 13 (Export Controls), 16 (State-Specific Notices), 17 (Governing Law and Venue), 18 (General), and 19 (Contact) survive any termination or expiration of these Terms.

12. Apps Obtained From the App Store

These Terms govern the Website. Each App is licensed under its own terms, which carry the provisions Apple requires for applications distributed through the App Store. If these Terms are ever held to govern your use of an App you obtained from the App Store, then the following applies to that use:

You agree not to export, re-export, or transfer any content, software, or technical data obtained from the Website in violation of United States export control laws or the applicable laws of any other country.

14. Electronic Communications

We have no user accounts, and we do not have your email address unless you write to us. You agree that we may give you legal notices about the Website, the Apps, and these Terms by posting them on the Website or presenting them in an App, and, if you have given us an email address, by email. A notice posted on the Website or presented in an App has the same effect as a written notice delivered to you, and takes effect when it is posted or first presented. You agree that these electronic communications satisfy any legal requirement that a communication be in writing.

You may give us notice by email at support@aiviation.dev. If you do not want to receive notices this way, stop using the Website and the Apps; because we do not know who you are, we have no other way to reach you.

15. Accessibility

We are committed to making the Website usable by everyone, including people with disabilities, and we work toward conformance with the Web Content Accessibility Guidelines (WCAG) 2.1, Level AA. If you have difficulty using any part of the Website, or a suggestion for improving it, contact support@aiviation.dev and we will make reasonable efforts to address it promptly.

16. State-Specific Notices

This Section applies to you only to the extent the identified state's law applies to you. Where a provision of this Section conflicts with another provision of these Terms, this Section controls for residents of that state.

California. Under California Civil Code Section 1789.3: the provider of this service is AIVIATION LLC, c/o Northwest Registered Agent, 7901 4th Street North, Suite 300, St. Petersburg, FL 33702, telephone 316-302-5551. The Website is provided at no charge; charges for our Apps are the subscription and in-app purchase prices displayed in the App before purchase. To resolve a complaint about the service or to receive further information about it, write to us at the address above or email support@aiviation.dev. You may also contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs, 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, telephone (800) 952-5210.

Nevada. Nevada residents may direct a business not to sell certain personal information under Nevada Revised Statutes Chapter 603A. AIVIATION LLC does not sell personal information. Our designated address for these requests is privacy@aiviation.dev.

Colorado, Connecticut, and Virginia. Residents of these states have privacy rights under the Colorado Privacy Act, the Connecticut Data Privacy Act, and the Virginia Consumer Data Protection Act. Those rights, and how to exercise them, are described in our Privacy Policy.

Residents of other states may have similar rights under their own laws; see our Privacy Policy.

17. Governing Law and Venue

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law principles. The exclusive venue for any dispute arising out of or relating to these Terms is the state or federal courts located in Florida, and you consent to the personal jurisdiction of those courts. This does not prevent either of us from bringing an individual claim in small claims court, or from seeking injunctive or other equitable relief in any court of competent jurisdiction to protect intellectual property rights. Nothing in these Terms limits any non-waivable rights you may have under the consumer-protection laws of your U.S. state of residence.

18. General

Changes to these Terms. We may update these Terms. When we do, we will change the "Last Updated" date above and post the revised Terms on this page. If the change is material, we will give more prominent notice. Your continued use of the Website after a revised version takes effect means you accept it.

Entire agreement and miscellaneous. These Terms, together with the Privacy Policy and any other policy referenced in them, are the entire agreement between you and AIVIATION LLC about the Website, and they replace any earlier agreement about it. If any provision is held invalid or unenforceable, it will be modified to the minimum extent necessary to make it enforceable, or severed if it cannot be, and the remaining provisions will stay in effect. Our failure to enforce a provision is not a waiver of it. In these Terms, "including" means "including without limitation." You may not assign these Terms without our prior written consent; we may assign them in connection with a merger, acquisition, or sale of assets, or to an affiliate. These Terms bind and benefit any permitted assignee.
